Terms of Service

Please read these terms carefully before using Partschain.co.nz. By accessing or using our platform you agree to be bound by these terms. If you do not agree, do not use the platform.

Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Partschain.co.nz platform (“Platform”) operated by Partschain Limited (“Partschain”, “we”, “us”). By registering an account, posting content, or browsing the Platform you accept these Terms in full.

If you use the Platform on behalf of a business, you warrant that you have authority to bind that business to these Terms.

The Platform

Partschain is a marketplace that connects buyers seeking auto parts with verified suppliers (dismantlers, wreckers, and dealers) across New Zealand. We provide the technology to facilitate connections — we are not a party to any transaction between buyers and sellers, and we do not hold, sell, or ship any parts ourselves.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice.

Accounts & Registration

  • You must be 18 years of age or older to register an account.
  • You are responsible for maintaining the security of your login credentials. Notify us immediately at support@partschain.co.nz if you suspect unauthorised access.
  • You must provide accurate and complete information during registration and keep it up to date.
  • One account per person or business entity. Creating duplicate or fraudulent accounts is prohibited.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

Buyer Obligations

As a buyer on the Platform, you agree to:

  • Use part requests and enquiries in good faith — only contact sellers if you have a genuine intention to purchase.
  • Not misrepresent your identity or purpose when contacting suppliers.
  • Conduct all transactions directly and honestly with sellers.
  • Not use contact information obtained through the Platform to spam or harass sellers.
  • Leave honest and accurate ratings based on your genuine experience.

Seller Obligations

As a Trade Member (seller) on the Platform, you agree to:

  • Provide accurate business information and maintain it up to date.
  • Only list parts you genuinely have available for sale.
  • Respond to matched part requests in a timely and professional manner.
  • Honour quoted prices and conditions when transacting with buyers.
  • Comply with all New Zealand consumer protection laws, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
  • Not engage in false advertising, misrepresentation, or deceptive pricing.
  • Obtain all necessary licences and permits required to operate your business lawfully in New Zealand.

Listing Standards

All part listings and content posted on the Platform must:

  • Accurately describe the part including condition (new / used / reconditioned), compatibility, and any defects.
  • Use real photographs where provided — stock images may not be substituted for actual item photos.
  • Include correct pricing in New Zealand Dollars (NZD).
  • Not infringe any third-party intellectual property rights.
  • Comply with all applicable New Zealand laws regarding the sale of automotive parts.

We reserve the right to remove any listing that does not comply with these standards without notice or liability.

Prohibited Activities

You must not, and must not attempt to:

  • Scrape, copy, or systematically extract data from the Platform without our written permission.
  • Use the Platform to distribute spam, malware, or unsolicited communications.
  • Reverse-engineer, decompile, or tamper with any part of the Platform's technology.
  • Circumvent any security or access controls on the Platform.
  • Post fraudulent, misleading, or defamatory content.
  • Use the Platform for any unlawful purpose or in violation of any applicable laws.
  • Solicit other users to transact outside the Platform to avoid our terms.

Intellectual Property

All content on the Platform (excluding user-submitted content) — including text, design, code, logos, and trademarks — is owned by or licensed to Partschain Limited. You may not reproduce, distribute, or create derivative works without our prior written consent.

By posting content (listings, photos, descriptions) to the Platform, you grant Partschain a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content for the purpose of operating and promoting the Platform.

Limitation of Liability

To the maximum extent permitted by New Zealand law, Partschain is not liable for:

  • Any loss or damage arising from transactions between buyers and sellers.
  • The accuracy, quality, safety, or legality of parts listed on the Platform.
  • Any indirect, incidental, or consequential loss arising from your use of the Platform.
  • Platform downtime, data loss, or security breaches beyond our reasonable control.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded under New Zealand law. Where the Consumer Guarantees Act 1993 applies, those statutory guarantees are not excluded.

Dispute Resolution

If you have a dispute with Partschain, please contact us first at support@partschain.co.nz. We will make every reasonable effort to resolve disputes informally within 20 working days.

Disputes between buyers and sellers are between those parties. Partschain may assist with mediation at our discretion but is not responsible for resolving private disputes.

Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts for any disputes arising from these Terms or your use of the Platform.

Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by displaying a prominent notice on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
